Affidavit of Identity for Summary Discharge - Instructions

Use the Affidavit of Identity for Summary Discharge to authorize the discharge of a judgment that has been registered against the wrong title or interest. You can find the regulations for discharging judgments under sections 175 of The Land Titles Act, 2000.

This affidavit must accompany the Application for Interest Discharge Form.

Completing the Affidavit of Identity

  1. Enter the full name of the person applying for discharge of a judgment. 
  2. Enter the relevant title number, interest register number, interest number or share number in the appropriate field.
  3. Enter the interest number of the judgment that has been registered against the above title, interest or interest share.
  4. Enter the full name of the debtor (the person referred to in the judgment). This indicates that the person named at the top of the form has been incorrectly associated with the judgment.
  5. Enter the place and province/state on the Location line, and fill in the Date line. This indicates the location and time of this affidavit.
  6. Have the officer sign on the A Commissioner for Oaths in and for Saskatchewan/ Notary Public line. If the officer is not a commissioner for oaths or notary public, they must check Other Person Authorized to Take Oaths. Rules for designating this authority can be found in the Land Titles Regulations, 2001.
  7. Enter the expiry date of the commissioner/notary public’s commission/appointment.
  8. Have the person named at the top of the form sign on the Signature line.

Submission

Send completed Affidavit of Identity for Summary Discharge together with Application for Interest Discharge and attachments, if any; with the Begin Attachment Sheet; and with the Land Registry Packet Cover Page, to:
