Titles Affidavit of Value - Instructions

ISC's fee schedule requires customers to submit affidavits to establish the values of new titles being issued. This ensures that the appropriate fee is charged for the transaction. Any person with knowledge of the value may complete an Affidavit.

Use the Titles Affidavit of Value when one or more existing titles – surface, mineral, or condominium – are being transferred or transmitted. The Affidavit allows a person to swear or affirm individual values for the titles involved, or one value for all the land involved.

Situation A - Individual Value 
  • At least one title or titles are being transferred or transmitted; and 
  • Person is able to swear or affirm an individual value for each title.

Situation B – Allocated Value 

  • At least two titles are transferred or transmitted to same transferee; 
  • There is one value given for all the land in the transaction; 
  • Person is able to swear or affirm one value for all the titles; and 
  • He or she allocates the single value among the titles involved.


The latter situation will arise where, by the same transaction, more than one title is being transferred to the same transferee for a certain value, but the transferor and the transferee have not otherwise allocated the value among the titles involved. In this case, a person may swear or affirm only one value for all the land involved. But in this Affidavit, he or she must also allocate that value among the titles involved, so that each title is allocated a specific value in the Affidavit. This information will then be used as a basis for values in the new titles.

The Titles Affidavit of Value may be used with the following applications: 
  • Application for Transfer (Single Title) 
  • Application for Transfer (Part I: Surrender) 
  • Application for Transfer to Surviving Joint Tenant 
  • Application for Transmission

How to complete the Titles Affidavit of Value:

Name: Insert the name of the person swearing or affirming the Affidavit.

Residence: Insert the place of residence and the province of residence.

Paragraph 2: Use this paragraph if the person doing the Affidavit is able to swear or affirm an individual value for each of the titles being transferred or transmitted.

Title Number – Insert number of existing title.

(You may replace Title Number with Application Sequence Number as means of referring to a title that is yet to be issued. For example, where the title is being transferred twice in the same packet – e.g. transmission and transfer.)

Value – Insert value of the existing title. This information must be consistent with the New Title Value information on the corresponding application form(s).
If you need additional space, please add additional rows as required. Do not add additional information on a separate sheet, as the value information and current text must precede the signature of the person swearing or affirming the Affidavit.

Paragraph 3: Use this paragraph when two or more titles are being transferred or transmitted to the same transferee, and the person doing the Affidavit is swearing or affirming only one value for all the titles, but is allocating the value among the titles. 
Value of all the land – Insert the value of all the titles involved.

Title Number – Insert number of existing title.

(You may replace Title Number with Application Sequence Number as means of referring to a title that is yet to be issued. For example, where the title is being transferred twice in the same packet – e.g. transmission and transfer.)

Value – Insert the value that is being allocated for that title. All the allocated individual values must total the single value. This information must be consistent with the New Title Value information on the corresponding application form(s).

If you need additional space, please add additional rows as required. Do not add additional information on a separate sheet, as the value information and current text must precede the signature of the person swearing or affirming the Affidavit.

Signature: The person swearing or affirming the Affidavit must sign the Affidavit in the presence of a Commissioner for Oaths, Notary Public, lawyer authorized to practise in Saskatchewan, or other person (specify position) authorized to take oaths.

Jurat: This section is completed by the official before whom the Affidavit is sworn or affirmed. He or she must add the place and province, date/month/year, and signature. If not a lawyer, he/she must add the expiry date of commission or appointment.

Do not amend this Affidavit to exclude any of the information currently contained in the Affidavit. You may insert additional information or text for explanatory purposes, if required.

Where to put the Titles Affidavit of Value …

In your packet, you should insert the completed Affidavit behind each: 
  • Application for Transfer (Single Title) 
  • Application for Transfer to Surviving Joint Tenant 
  • Application for Transmission

The Affidavit must always follow each of these applications, behind any authorization documents required by the application. It is acceptable to include values for all the titles being dealt with on one Affidavit and then insert a copy of the same Affidavit behind each application that requires reference to a value on that Affidavit.

If your packet involves surrender and set-up applications, insert the Affidavit after: 
  • Application for Transfer (Part I – Surrender), behind authorizations
