Transform Affidavit of Value - Instructions

ISC's fee schedule requires customers to submit affidavits to establish the values of new titles being issued. This ensures that the appropriate fee is charged for the transaction. Any person with knowledge of the value may complete an Affidavit.

Use the Transform Affidavit of Value in the following circumstances: 
  • An approved plan creates one or more new parcels; 
  • A Transform Approval Certificate (TAC) has been issued; and 
  • Client is applying for title(s) to the parcel(s) created by the plan.

A transform may involve consolidation or subdivision. In both cases, all the parcels are new in the sense that they do not currently exist but will exist when titles are issued. However, in some cases, a plan may create parcels that are "remainder" parcels. A "remainder" parcel is defined as the balance of an existing parcel, after a new parcel has been taken out, but where the boundaries of the existing parcel otherwise remain unchanged. The distinction is important because The Land Titles Regulations, 2001 do not require that a value be provided for a remainder parcel if the person states that he or she does not have knowledge of its value.

This Affidavit may be used to provide values in both the following situations:

Situation A – New Parcels (No Remainder Parcels) 

  • The plan creates at least one new parcel. 
  • None of the parcels created are "remainder" parcels. 
  • Person must swear or affirm a value for each parcel.

Situation B – New Parcels (Including Remainder Parcels) 

  • The plan creates at least two new parcels. 
  • At least one of the parcels is a "remainder" parcel. 
  • Person must swear a value for each non-remainder parcel. 
  • Person has option of swearing a value for each remainder parcel or stating that he or she has no knowledge of such value and inserting "N/A" for the value.

How to complete the Transform Affidavit of Value …

Name: Insert the name of the person swearing or affirming the Affidavit.
 
Residence: Insert the place of residence and the province of residence.

Paragraph 1: Insert the Transform Number from the TAC.

Paragraph 2: Compete this paragraph for the new parcel or parcels that are created by the approved plan but are not "remainder" parcels.

Parcel Number – Insert the Parcel Number for each new non-remainder parcel. This information can be found on the TAC.

Value – Insert the value of the parcel. This information must be consistent with the New Title Value information on the corresponding application form(s).

If you need additional space, please add additional rows as required. Do not add additional information on a separate sheet, as the value information and current text must precede the signature of the person swearing or affirming the Affidavit.

Paragraph 3: Use this paragraph to state the value of any parcel or parcels created by the approved plan that are "remainder" parcels.

Parcel Number – Insert the Parcel Number for each new remainder parcel. This information can be found on the TAC.

Value – Insert the value of the parcel, or indicate "N/A" if the person swearing or affirming the Affidavit does not know the parcel value. If a value of "N/A" is stated here, the New Title Value box on the corresponding application form(s) must be completed as "N/A" or $0. The resulting title will show value as "N/A". 

                                                    OR

Select only the text, "The approved plan does not create any remainder parcels."

Paragraph 4: Select this paragraph if the person completing the Affidavit does not have knowledge of the value of one or more of the remainder parcels listed in Paragraph 3. For those parcels, a value of "N/A" must be indicated accordingly in Paragraph 3.

Signature: The person swearing or affirming the Affidavit must sign the Affidavit in the presence of a Commissioner for Oaths, Notary Public, lawyer authorized to practise in Saskatchewan, or other person (specify position) authorized to take oaths.

Jurat: This section is completed by the official before whom the Affidavit is sworn or affirmed. He or she must add the place and province, date/month/year, and signature. If not a lawyer, he/she must add the expiry date of commission or appointment.

Do not amend this Affidavit to exclude any of the information currently contained in the Affidavit. You may insert additional information or text for explanatory purposes, if required. 

Where to put the Transform Affidavit of Value …

In your packet, you should insert the completed Affidavit after:

  • Application for Transfer (Part I – Surrender), behind authorizations
