Application for Interest Amendment - Instructions

Use the Application for Interest Amendment to amend an existing interest. The amendment will affect all the interests under a particular interest registration (identified by Interest Register Number). Be sure to include an Interest Authorization and any supporting documents.

NOTE:  Only the holder of an existing interest has the authority to amend or change that interest. Include a completed Interest Authorization with this application.

Your completed Application should include:
  • Packet Cover Page*
  • Application for Interest Amendment
  • Interest Authorization*
  • Additional Interest Holders* (if applicable)
  • Title Print Request* (optional)
  • Begin Attachment Sheet* (if applicable)
  • Attachments (if applicable)

Use this Application to do any of the following:
  • Delete, add, or amend a Scheduled Expiry Date
  • Add or change the Interest Value
  • Add a Feature Number if an approved plan shows the interest
  • Add or amend the Description of Interest
  • Delete the existing Description of Interest
  • Add new attachment documents
  • Delete current attachment documents
  • Add the interest to other Parcels, Titles, Interests or Interest Shares

Note:  Do not use this Application to “remove” the interest from a title, parcel, interest or interest share. In that case, you must complete an Application for Interest Discharge.

How to complete an Application for Interest Amendment:

NOTE: Complete the Application Sequence Number after you
have completed and assembled the application. See Step 10 below.

Step 1: Interest Register Number

Enter the Interest Register Number of the interest you want to amend. This can be found on the Title Print or through a Land Registry search.

Step 2: Interest Type

Enter the Interest Type as it appears on the Title Print.

Step 3: Conditions

Check or enter details in one of the following three choices: (If you do not select one and provide details, if required, your application will be rejected.)
  • No Conditions - Check this box if you will accept registration of this amendment subject to any interests registered against the title or existing in the Judgment Registry at the time that this application is processed.
  • Conditional Registration Date and Time - Complete this box if you will accept registration subject to interests registered on the title or existing in the Judgment Registry at a particular date and time. Enter the date as dd-mm-yyyy and the time as hh:mm:ss. For example, if you searched a title on October 15, 2003, at 2:30 p.m. and chose this date and time, you would enter 15-10-2003 and 14:30:00.
  • Free and Clear Registration – Check this box if you will accept registration only if there are no interests on the title at the time this application is processed.

*** Please note that if the last two types of registration conditions cannot be met, then your Interest Amendment Application cannot be processed and will be rejected.

THE FOLLOWING SECTIONS OF THE APPLICATION PERMIT YOU TO AMEND CERTAIN ASPECTS OF YOUR CURRENT INTEREST REGISTRATION.  COMPLETE ONLY THOSE AREAS BELOW THAT ARE REQUIRED, DEPENDING ON THE NATURE AND EXTENT OF YOUR AMENDMENT(S).

Step 4: Scheduled Expiry Date

To add or change an existing expiry date on which you want this interest registration to automatically expire, enter the new date as dd/mm/yyyy. Note that in certain cases, the expiry date will automatically be entered.
  • To delete an existing expiry date, write in the word “DELETE” in this area.

Step 5: Interest Value

If you wish to add or change an existing interest value, enter the new value here. A value is mandatory for these interests and cannot be deleted:
  • Mortgage
  • Mortgage - Annuity
  • Builders’ Lien
  • Bank Act Security
  • Condominium Property Act - Arbitration Costs
  • Condominium Property Act - Lien for Arrears
  • Public Guardian and Trustee Act – Lien for Expenses
  • Provincial Lands Act - Interest

Step 6: Feature Number

If the interest is one that applies to less than a full parcel, e.g. easement, and is shown on a plan approved by Plan Processing, enter the Feature Parcel Number. This number can be found on the Feature Approval Certificate issued by PPS.

Step 7: Description of Interest

Use this area if you want to add an interest description or amend an existing description. Note that in general, an interest registration must have a Description of Interest or an attachment document referencing the interest, but not both. If you choose to attach a document, you must insert the document after a Begin Attachment Sheet.
  • NOTE: Parking designations under The Condominium Property Act will require both an attachment document(Form D or F.1) and a description of the space(P1 etc).
  • Check the Delete Description of Interest box if you are replacing the existing description with either an amended description or an attachment document as discussed above.

Step 8: Attach Interest to

Use the Attach Interest to section to add the interest to additional parcels, titles, other interests or other interest shares. Parcel numbers, title numbers, interest numbers and share numbers can be found on the Title Print or by a Land Registry search.

Complete only one number per row.
  • Parcel Number – Enter the parcel number to add this interest to that parcel.
  • Title Number – Enter the title number to add this interest to that title.
  • Interest Number – Use this to register the existing interest as a sub-interest against another interest that exists in the Land Registry.
  • Share Number – Use this to register the existing interest against a particular share of another interest that exists in the Land Registry.
  • Application Sequence Number – Use this to register the interest against a title that is being issued as part of the same packet. If the title is being created in the fifth application in the packet, indicate “5” as the Application Sequence Number.
  • Abstract Number – Use this to add the interest to a parcel of unpatented Crown land. To find the Abstract Number, search by Land Description in the Land Registry.

Selecting the (*) and (**) boxes:
Use the Dominant Box if the existing interest is an easement, restrictive covenant or party wall agreement:

  • If required, add this interest to new parcel numbers.
  • Check the (*) box if the parcel being added is dominant.

NOTE: For easement mutual, restrictive covenant-mutual and party wall agreement, all parcels added are dominant and must have the (*) box selected.

NOTE: If you are attaching the interest to new parcels, titles, interests or interest shares, you must complete and attach an Additional Interest Holders form. If the interest holders are the same as in the current interest registration, you must set up the holders exactly as for the current interest registration. For example, if you are adding parcels to a mortgage held by CIBC, indicate on the Additional Interest Holders form that the holder is CIBC, using the same client name and number as now shown for the interest.

Step 9: Document Information

Use this section to remove any attachments that you no longer wish to be part of the interest registration. Enter the Document Number for the attachment. This number may be found by searching this Interest Registration Number in the Land Registry.
  • Remember when deleting documents that as a general rule, an interest registration must have either a Description of Interest box text or an attachment document, and that for some statutory interests, the document attachments are mandatory and should not be deleted. For further information, please contact the Land Registry at 1-866-275-4721.

Step 10: Application Sequence Number

Enter the number indicating the order of this application in the packet. For example, if it is the second of four applications, indicate “2”.

Application Sheet Count – Enter the total number of sheets in this application, as well as in any of the following that are required: Additional Interest Holders, Title Print Request, Begin Attachment Sheet, and attachment(s). All sheets submitted should be single-sided.
