Application for Interest Assignment - Instructions

Use the Application for Interest Assignment to assign an existing interest to another person or entity. By assigning an interest, you are changing the holder. The current holder may assign some or all of the interests associated with an interest registration.

Example: Prairie Bank has registered a mortgage against five parcels of land – and holds five interests as a result. If it wants to assign the mortgage it holds on two of the parcels to Souris Credit Union, it would be assigning only those two interests. Alternatively, Prairie Bank may assign all five interests to Souris Credit Union.

How to use this Application:
  • An interest can be registered against one or more titles, parcels or interests. The holder of the interest can choose to assign that interest in full or in part to another person or entity – in short, the holder of the interest changes.
  • The new holder may be one or more persons or entities. If more than one, they may hold the assigned interest jointly, or may hold separate fractional shares.
  • If more than one share, use the Additional Interest Holders form to indicate the other owner(s) and their fractional share(s) in the assigned interest.

NOTE: 
Only the holder of an interest has the authority to assign the interest. Include a completed Interest Authorization with this application.

How to complete an Interest Assignment Application:

NOTE: Complete the Application Sequence Number last, after you have completed and assembled the application. See Step 5 below.

Step 1: Interest Register Number

Enter the Interest Register Number of the interest you want to assign. This can be found on the Title Print or through a Land Registry search.

Step 2: Interest Type

Enter the Interest Type as it appears on the Title Print.

Step 3: Complete one of the following:

Assignment of Interest – Enter the Interest Number of the interest you wish to assign. You are assigning the all the shares in the interest identified by that Interest Number.

Assignment of Shares – Use this to assign only part of an interest identified by a particular Interest Number. Enter the Interest Number and the Share Number to be assigned. Example: A lease is held by Josie and Alex. Josie has a 1/3 share in the interest, and Alex has a 2/3 share. Josie wishes to assign her share to Cathy. In this case, enter the Interest Number that identifies the lease and the Share Number that identifies Josie’s share.

Step 4: Fractional Share

For each share of the Interest or Interest Share that is being assigned, you must complete the Fractional Share box and either Section A or B.

Fractional Share – If there is only one holder or multiple holders who will hold the interest or interest share jointly, enter 1/1. If there is more than one holder and each holds a separate share, the fractional shares for the interest can be expressed in any way as long as all the shares equal 1/1, e.g. three separate holders may be 2/3, 1/6 and 1/6.

* The fractional share may depend on the share being assigned. Example: A share of a particular interest is being assigned to Max and this share represents a 1/3 interest. In assigning this share to Max, the new fractional share for Max must be indicated as 1/3.

Section A – Interest Holder(s) with Client Numbers(s)
Client Number(s) – If the interest holder has an ISC client number, enter it here.

Client Name – Enter the client name exactly as it corresponds to the client number in the Land Registry database. There is space to indicate if two holders are joint holders of an interest share. For example, Al and Beth are joint holders of a 1/1 share in the interest.

NOTE: If you wish to amend the address information associated with a client number, please complete a Client Application and submit it separately to e-Business. Similarly, if you wish to amend the name associated with a client number, submit an Affidavit of Identity and Change of Name application separately to e-Business. In either case, please ensure that your changes are confirmed before submitting the Interest Assignment Application.

Section B – Interest Holder(s) without Client Number(s)
Complete this section if the new interest holder does not have an ISC client number.

Enter in full name of the person or the organization/firm that will be the interest holder. If an individual, please provide full names and refrain from using initials.

Enter in full the address and phone number of the interest holder. If available, enter the email address and the fax number.

*** If two or more persons or entities will be holding separate shares in the assigned Interest or Interest Share, complete and attach an Additional Interest Holders form.

Step 5: Application Sequence Number

Enter the number indicating the order of this application in the packet. For example, if it is the second of four applications, indicate “2”.
