Application for Interest Registration - Instructions

Use the Application for Interest Registration to create the registration of a new interest and attach it to one or more existing title(s), parcel(s), interest(s) or interest share(s). For a complete list of Interest Types available, see Schedule A of this Instruction Sheet.

Your completed Application should include:
  • Packet Cover Page*
  • Application for Interest Registration
  • Additional Interest Holders* (if required)
  • Title Print Request* (optional)
  • Begin Attachment Sheet* (if applicable)
  • Attachments (if applicable)

How to use this Application:
Determine the correct Interest Type for your registration. Also determine which title(s), parcel(s), interest(s) or interest share(s) are subject to the Interest.

If the interest has or requires a value, the figure may include cents.

Registration of an interest constitutes notice to third parties. Notice may be given by describing the interest on the Application or by attaching reference documents. The extent of disclosure given to third parties is the responsibility of the client.

As a general rule, ISC does not review or check attached documents.

For certain Interest Types, the governing legislation may require that a prescribed form or document accompany this Application. If you have any questions in regard to a statutory interest please consult the statute.  The statute is available from the Queen’s Printer.

NOTE:  Be sure to enter the correct Interest Type. This ensures that proper priority and notice to third parties
will be given to the Interest.


How to complete an Interest Registration Application:

NOTE:  Complete the Application Sequence Number and Application Sheet Count last, after you have completed and assembled your entire application. See Step 10 below.



Step 1: Interest Type

Enter one of the interest types that are listed on the on-screen dropdown menu, or listed in Schedule A of this Instruction Sheet.

Warning:  If you intentionally register an interest based on a mortgage as another interest type, no compensation is payable under subsection 84(2) of The Land Titles Act, 2000 for any loss, damage or deprivation suffered by any party as a result of the registration. Registering a mortgage as any other interest type bars all claims for compensation.



Step 2: Holder’s Mortgage or Interest Reference Number

Enter if you wish to provide your own reference number. This number will appear on verification statements sent to you.



Step 3: Conditions

Check or enter details in one of the following three choices (If you do not select one and provide details, if required, your application will be rejected):
  • No Conditions - Check this box if you will accept registration of the interest subject to any interests registered against the title or existing in the Judgment Registry at the time that this application is processed.
  • Conditional Registration Date and Time - Complete this box if you will accept registration subject to interests registered on the title or existing in the Judgment Registry at a particular date and time. Enter the date as dd-mm-yyyy and the time as hh:mm:ss. For example, if you searched a title on October 15, 2003, at 2:30 p.m. and chose this date and time, you would enter 15-10-2003 and 14:30:00.
  • Free and Clear Registration – Check this box if you will accept registration only if there are no other interests on the title at the time this application is processed.

    *** Please note that if the last two types of registration conditions cannot be met, then your Interest Registration Application cannot be processed and will be rejected.




Step 4: Scheduled Expiry Date

To have this registration to automatically expire, enter the date as dd/mm/yyyy. On that date, the system will automatically discharge the interest.



Step 5: Interest Value (if applicable)

If applicable. A value is mandatory for the following interest types:
  • Mortgage
    • Mortgage
    • Mortgage - Annuity
  • Builder's Lien
    • Bank Act Security
    • Condominium Property Act - Arbitration Costs
    • Condominium Property Act - Lien for Arrears
    • Public Guardian and Trustee Act – Lien for Expenses
    • Provincial Lands Act - Interest




Step 6: Feature Number

If the interest is one that applies to less than a full parcel, e.g. easement or pipeline right of way, and is shown on a feature plan approved by Plan Processing, enter the Feature Parcel Number that is located on the Feature Approval Certificate.



Step 7: Description of Interest

You may enter a description of the interest, up to 180 characters, or attach a document referencing the interest. If you choose to attach a document, insert the document after a Begin Attachment Sheet and leave this section blank.

In certain cases, specific statutes will require that certain interest types be accompanied by prescribed forms or documents. If you have questions about whether a Begin Attachment Sheet is required in a particular case, please contact 1-866-ASK-ISC1 (275-4721).





Step 8: Attach Interest to

The Attach Interest to section is used to indicate which title(s), parcel(s), interest(s) or interest share(s) you wish the interest to attach to. To find the title number, parcel number, interest number or share number, review the Title Print or do a Land Registry Search.

Complete only one number per row.
  • Parcel Number – Use this if the interest affects all titles in the parcel.
  • Title Number – Identifies the title against which the interest will be registered.
  • Interest Number – Use this to register a sub-interest against an interest. Identifies an interest within an Interest Register that relates to a specific title.
  • Share Number – Identifies a portion of interest held by one interest holder, where more than one person or corporate entity has a share in the interest. Use this to register a sub-interest against a specific portion of that interest.
  • Application Sequence Number – Use this to register the interest against a title that is being issued as part of the same packet. If the title is being created in the fifth application in the packet, indicate "5" as the Application Sequence Number.
  • Abstract Number – Use this to file the interest against unpatented Crown land. To find the Abstract Number, do a search by Land Description in the Land Registry.

Selecting the (*) and (**) boxes:
When registering an easement, restrictive covenant or party wall agreement:
  • Always provide at least 2 parcel numbers
  • Always check the (*) box to indicate the parcel that is dominant
  • At least 1 parcel must be selected as the dominant parcel
  • The current owner of the dominant parcel(s) is the interest holder, for the purposes of completing page 2 of the Application for Interest Registration.

    NOTE: For easement mutual, restrictive covenant-mutua l and party wall agreement, all parcels are dominant and must have the (*) box selected.

When registering a postponement:
  • Register against interest numbers only.
  • Always provide at least 2 interest numbers.
  • Always check the (**) box to indicate the interest that is benefiting from the postponement.
  • The holder of the benefiting interest is the interest holder of the postponement, for the purposes of completing page 2 of the Application for Interest Registration.

    NOTE: When registering a postponement, leave the Description of Interest box blank and insert behind a Begin Attachment Sheet a copy of the postponement agreement.




Step 9: Fractional Share

Enter the holder(s) of the interest on page 2 of the Interest Registration Application. For each interest share, complete the Fractional Share and either Section A or B.

Fractional Share – Enter the share of the interest. If there is only one holder or multiple holders who will hold the interest jointly, enter 1/1. If there is more than one holder and each holds a separate share, the fractional shares can be expressed in any way as long as all the shares equal 1/1, e.g. three separate holders may be 2/3, 1/6 and 1/6. Please note, you will need to enter the complete fraction including the "/".

Section A – Interest Holder(s) with Client Numbers(s)
Client Number(s) – If the interest holder has an ISC client number, enter it here.
Client Name – Enter the client name exactly as it corresponds to the client number in the Land Registry database. There is space to indicate if two holders are joint holders of an interest share. For example, A and B are joint holders of a 1/1 share in the interest.

NOTE: If you wish to amend the address information associated with a client number, please complete a Client Application and submit it separately to e-Business. Similarly, if you wish to amend the name associated with a client number, submit an Affidavit of Identity and Change of Name application to e-Business. Please ensure that such changes are confirmed before you submit the Interest Registration Application. For more information, call 1-866-275-4721.


Section B – Interest Holder(s) without Client Number(s)
Complete this section if the interest holder does not have an ISC client number.

Enter in full name of the person or the organization/firm that will be the interest holder. If an individual, you must provide full names and refrain from using initials.

Enter in full the address and phone number of the interest holder. If available, enter the email address and the fax number.

* Complete and attach Additional Interest Holders form, if required.





Step 10: Application Sequence Number

Enter the number indicating the order of this application in the packet. For example, if it is the second of three applications, indicate "2".
