Application for Transfer to Surviving Joint Tenant - Instructions

When owners are joint tenants of a title, they own the title without separate shares. This form of ownership allows for an automatic right of survivorship. If one of the owners dies, his or her share in the title may pass automatically to the surviving joint tenant(s). Note: This does not apply if the ownership is specified on title as “Joint Tenants with no survivorship”.

Use this Application when:
  • One or more Title Owner(s) in a joint tenancy is deceased.
  • His or her share is to be transferred to the surviving Joint Tenant(s).

Your completed Application should include:
  • Packet Cover Page*
  • Application for Transfer to Surviving Joint Tenant
  • Titles Affidavit of Value*
  • Affidavit of Surviving Joint Tenant
  • Death Certificate issued by Vital Statistics (Sample Certificate)
  • Title Print Request (optional)*

Affidavit of Surviving Joint Tenant and Proof of Death of Deceased Joint Tenant
To complete this Application, you must attach an Affidavit of Surviving Joint Tenant by the surviving Joint Tenant listed on the title. As a general guide, the Affidavit of Surviving Joint Tenant must:

  • state that the signator is one of the registered Joint Tenants on title
  • attach a Death Certificate, Letters Probate or Letters of Administration for the deceased Joint Tenant
  • state that the person named in the Death Certificate is the same person as the deceased Joint Tenant
  • state that the Affidavit is made in support of an application for the signator to be registered as owner of the title
  • be signed in the presence of a commissioner for oaths, notary public or other official • be sworn or affirmed before a commissioner for oaths, notary public or other official

NOTE:  This Application must be accompanied by proof of death of the deceased Joint Tenant. Please see below for further information.

You must also attach a copy of the official Death Certificate for the deceased Joint Tenant, as issued by Vital Statistics - www.ehealthsask.ca/residents/deaths or from a similar authority if from another jurisdiction. Letters Probate or Letters of Administration is also acceptable.

As a rule, any other proof of death, such as the Statement of Death filed with Vital Statistics, or the funeral director’s certificate, is not acceptable and the packet will be rejected.

* If there are two or more surviving Joint Tenants, only one need complete an Affidavit of Surviving Joint Tenant on behalf of all the survivors. The Affidavit should be modified accordingly.

How to complete an Application for Transfer to Surviving Joint Tenant: 
NOTE:  Complete the Application Sequence Number.





Step 1: Title Number

Enter the TitleNumber for the existing Joint Tenant Title.

Note:  If the Joint Tenants owned more than one title, complete a separate Application for Transfer to Surviving Joint Tenant for each title. You may use an Affidavit of Surviving Joint Tenant that covers all the titles for which the client number of the Surviving Joint Tenant is the same.





Step 2: New Title Value

Enter the fair market value of the title, rounded down to the nearest dollar. This value must be consistent with the value in the Titles Affidavit of Value.



Step 3: Surviving Title Owner(s)

Client Number - Enter the client number for the surviving Title Owner. Use the client number which appears on the existing Joint Tenancy Title.

Client Name – Enter the name which corresponds to the aboveClient Number.

* Repeat as required for any other surviving Title Owner(s).

What if the information associated with your Client Number has changed?
If your address has changed, complete a Client Application Form and submit to e-Business separately. Wait until your address change is confirmed before you submit this application.

If your name has changed, complete an Affidavit of Identity and Change of Name form and submit separately to e-Business. Submit this application when the change is confirmed.

If the client name of the Surviving Joint Tenant contains an initial:
Amend the name so that it no longer contains an initial by completing an Affidavit of Identity and Individual Name Correction form and submitting them separately to e-Business. Please wait until the name amendment is confirmed before submitting this application.





Step 4: Deceased Title Owner(s)

Client Number - Enter the Client Number of the deceased Title Owner. Use the client number which appears on the existing Joint Tenancy Title.

Client Name – Enter the name which corresponds to the above Client Number.

* Repeat as required for any other deceased Title Owner(s).



Step 5: Application Sequence Number

Enter the number indicating the order of this application in the packet. For example, if it is the first of two applications, indicate "1".

Application Sheet Count – Effective July 19, 2004 this field is no longer required.
