Consent of Mortgagee to Transform - Instructions

Use the Consent of Mortgagee to Transform when a transform occurs and there is a mortgage on any of the titles being surrendered. If there are more than one Mortgagee for the parcel, each must complete a consent form. Submit form(s) together with Application for Transfer (Part I: Surrender)

Completing the Consent of Mortgagee to Transform Form… 

AUTHORIZATION

Enter the Name exactly as it appears on the Title Print, or the name of the corporate signing officer.

Enter the Position held in the corporation, if authorized by the corporate signing officer.

Enter the Corporation Name, if applicable, as it appears on the Title Print.

Enter the Transform Number, which must match the number entered on the Application for Transfer (Part I: Surrender).

Enter the Date authorization is being signed.

Sign on the Signature line.

Have your witness sign on the Witness Signature line. Note that in the case of a corporate interest holder, no witness is required if the signature of the corporate signing officer is accompanied by a corporate seal that is visible. See information below.

NOTE:  Using a Corporate Seal:
  • Use a corporate seal if the corporation is registered to operate in Saskatchewan.
  • The seal must be visible when the packet has been submitted to the Land Registry.
  • If the corporate seal will not be visible upon submission, e.g. seal is embossed or is illegible upon photocopying, include a completed Certificate of Lawyer/Notary.
Check the box If Witness is a Lawyer (if applicable) and print lawyer’s name on the Lawyer Name line.

If your witness is a Lawyer in and for the province of Saskatchewan you may skip the next section AFFIDAVIT OF EXECUTION. AFFIDAVIT OF EXECUTION (If witness other than Lawyer)

Have your witness enter his/her name on the Witness Name line and the place name and province or state on the Location line.

The witness must make an oath saying that he/she has witnessed the signing of this authorization by the authorizing party, and believes that the authorizing party is at least eighteen years of age.

The Affidavit requires the witness to enter the authorizing party’s name on the applicable Signature line: as either a person he/she personally knows or whose true identity has been verified as the authorizing party.

Enter the place and province/state on the Location line, followed by the Date. This indicates the location and time of this affidavit.

Have the witness sign on the Witness Signature line; this must match the signature in the Authorization section of the form.

Have A Commissioner for Oaths in and for Saskatchewan/ Notary Public sign on the line and indicate whether s/he is a Commissioner or Notary.

If the officer is not a Commissioner for Oaths or Notary Public, he/she must specify Other person authorized to take Oaths. Enter commission/appointment expiry date of the Commissioner/Notary Public.

Note: If the witness wishes to affirm, or the affidavit is sworn outside Saskatchewan, make the appropriate changes to the form.

If you are completing this Authorization as a representative of a corporation without a seal, complete the next section AFFIDAVIT VERIFYING CORPORATE SIGNING AUTHORITY. 

AFFIDAVIT VERIFYING CORPORATE SIGNING AUTHORITY

Enter the Name as it appears at the top of the Authorization section of the form.

Enter on the Location line the place and province/state where the corporate signing officer resides.

Enter the Corporation Name, which must match the name stated in the Authorization section.

Sign on the Corporate Officer Signature line. This must match the signature in the Authorization section.

The Commissioner of Oaths/Notary Public, or other authority, must enter the place and province/state on the Location line. This indicates the location and time of this affidavit.

Have A Commissioner for Oaths in and for Saskatchewan/ Notary Public sign on the line and indicate whether s/he is a Commissioner or Notary.

If the officer is not a Commissioner for Oaths or Notary Public, he/she must specify Other person authorized to take Oaths. Send completed Land Registry Packet Cover Page; Application for Transfer (Part I: Surrender); Transform/Multiple Transfer Authorization; Consent of Mortgagee to Transform); Application for Transfer [Part II: Setup(s)] and if required a Bring Attachment Sheet followed by any attachments:
