Application for Transmission - Instructions

Complete this Application to transfer title from a title owner who is deceased to his or her personal representative (an executor or administrator of estate) or to transfer title from a title owner who is bankrupt to his or her trustee in bankruptcy (summary or ordinary).

If there are more than two person representatives or trustees who will be owners of the new title, please complete an Additional Title Owners form.

The completed packet should include all these, be in the following order, and be sent through email, fax, or mail:

  • Land Registry Packet Cover Page
  • Application for Transmission
  • Copy of Letters Probate or Letters of Administration**
  • Copy of Local Registrar’s Certificate**
  • Affidavit of Identity—Transmission to Personal Representative (the personal representative is required to complete if the name is set out differently than it appears in the Court documents)
  • Titles Affidavit of Value
  • Title Print Request (optional)

NOTE:
  To transmit a title to a personal representative or a trustee in bankruptcy, be sure to include the proper authorizations.


Authorizations required to transmit to Trustee in Bankruptcy:
If the title is being transmitted to a Trustee in Bankruptcy, attach a copy of either:
  • Assignment in Bankruptcy; or
  • Receiving Order

Authorizations required to transmit to Personal Representative:
If the title is being transmitted to a Personal Representative, the following apply:
  • If an executor, attach a copy of the Letters Probate issued by the Court of Queen’s Bench in Saskatchewan. If the Letters Probate were issued in another jurisdiction, they must be resealed by the Court of Queen’s Bench in Saskatchewan before you submit them as part of this Application.
  • If an administrator, attach a copy of the Letters of Administration (with Will Annexed or de Bonis Non) issued by the Court of Queen’s Bench in Saskatchewan. If the Letters of Administration were issued in another jurisdiction, they must be resealed by the Court of Queen’s Bench Bench in Saskatchewan before you submit them as part of this Application.

    About Local Registrar’s Certificate - When the court issues the Letters of Probate or Letters of Administration, it may also issue at the same time a Local Registrar’s Certificate stating that no infants are interested in the property of the estate. (This is done only if a request for a Local Registrar’s Certificate is made by the executor or administrator.)

    If you attach the Local Registrar’s Certificate with this Application, the new title may be subsequently transferred to another party, e.g. a beneficiary. If you do not attach such a Certificate, the new title issued to the Personal Representative will be locked. To subsequently transfer the title, a Public Trustee’s Certificate must accompany the application.

How to complete an Application for Transmission:
NOTE: Complete the Application Sequence Number.

Step 1: Title or Sequence Number

Enter the Title Number for the existing Title. This can be found through a Land Registry Search. If you are transmitting a title that has been transferred within a previous sequence within the same packet you may enter the sequence number of that transfer.

Note: If the deceased person or bankrupt owned more than one title, you must complete a
separate Application for Transmission for each title that must be transmitted.

Step 2: Transmission to

Check one of the boxes, as applicable.
  • Personal Representative (executor or administrator of estate)
  • Trustee in Bankruptcy (Ordinary)
  • Trustee in Bankruptcy (Summary)

Step 3: New Title Value

Enter the fair market value of the title, rounded down to the nearest dollar. This value must be consistent with the value in the Titles Affidavit of Value.

Step 4: Deceased or Bankrupt

Client Number - Enter the Client Number of the deceased or bankrupt Title Owner. Use the client number which appears on the existing Title.

Client Name – Enter the name which corresponds to the above Client Number.

Step 5: For each Personal Representative or Trustee in Bankruptcy, complete Section A or B

If a corporation, the Personal Representative or Trustee must complete Section A.

Section A – Personal Representative(s) or Trustee(s) with Client Number(s)

Client Number(s) - If the personal representative or trustee as an ISC client number, enter it here. If a corporate entity, you must use an ISC client number that is linked to its Corporations Branch (COBRA) entity number. For client numbers, call 1-866-275-4721.

Client Name – Enter the client name. The name must exactly match that given for the client number in the Land Registry database, or the application will be rejected.

What if the information associated with your Client Number has changed?
If your address has changed, complete a Client Application Form and submit to ISC separately. Please wait until your address change is confirmed before you submit this application.

If your name has changed, complete an Affidavit of Identity and Change of Name form and submit separately to e-Business. Submit this application when the change is confirmed.


If the client name of the new owner (individual) contains an initial …
Amend the name so that it no longer has an initial by completing a Client Application form. Please wait until your name amendment is confirmed before you submit this application.

Section B – Personal Representative(s) or Trustee(s) without Client Number(s)

Complete this section if the Personal Representative or Trustee in Bankruptcy is an individual and does not have an ISC client number. Note: If the Personal Representative or Trustee in Bankruptcy is a corporate entity, you must complete Section A.

Enter in full name of the individual who will be the personal representative or trustee in bankruptcy. You must provide full names and refrain from using initials.

Enter in full the address and phone number of the personal representative or trustee in bankruptcy. If available, enter the email address and the fax number.

Step 6: Application Sequence Number

Enter the number indicating the order of this application in the packet. For example, if it is the first of three applications, indicate “1”.

Application Sheet Count – Effective July 19, 2004 this field is no longer required.
