Individual Change of Name - Instructions

Use this form when a person’s legal name has changed.

Note: The Individual Client Number Amalgamation form can be submitted at the same time as the Individual Change of Name form.

Completing the Individual Change of Name form

SECTION A – CLIENT INFORMATION

Enter the New Client Name. This is the new legal name you want to appear in the Land Registry.

Note: S. 10 of The Land Titles Regulations, 2001 provides that an individual is to hold title in their given name, middle name, if any, and family name. Given name is their first name as it appears on their birth certificate unless legally changed. If a person has a middle name it is to be used as well as their last name. An individual should not use shortened versions (Alex for Alexander) or an alias (Tracy Kimberley Smith goes by Kim Smith) for Land Registry purposes.

OPTIONAL - Check the appropriate Generation Indicator if applicable.
This is used if this is part of your legal birth name or to distinguish between two individuals in the Land Registry with identical names.
  • Example: three men in a family such as a grandfather, father and son all have the same name John William Smith, so they indicate John William Smith I, John William Smith II, and John William Smith III.
  • Or a mother and daughter have the same name of Jane Lynn Klassen so the mother indicates Jane Lynn Klassen Senior and the daughter indicates Jane Lynn Klassen Junior.)

SECTION B – OTHER CLIENT NUMBERS

List the Client Number(s) and Existing Client Name(s) that you wish to change to the New Client Name indicated in Section A. Enter the Client Number(s) and the Client Name that corresponds with that Client Number exactly as it currently exists in the Land Registry.

Ensure that the Client Name corresponds with that Client Number exactly as it currently exists in the Land Registry. If the Client Name and Client Number do not match those in the Land Registry, the application will be rejected.

Attached check box - If there is not enough space in the boxes provided or if you wish to provide the Client Numbers and Client Names associated with those numbers on a separate list, please indicate and attach the list to the form.

SECTION C- SUBMITTING PARTY INFORMATION

Provide the contact information for the person to contact if any questions arise in reviewing the application or to inform that the request has been completed.

Please complete and attach the Affidavit for Individual Change of Name required under section 80 of The Land Titles Regulations, 2001.

INFORMATION REGARDING PERSON MAKING APPLICATION
The client in Section A must enter his/her name on the New Name line and Town/City on the Location line and province on the Province line.

PARAGRAPH 1 – INFORMATION REGARDING THE APPLICANT
The individual swearing the affidavit specify the Name recorded in the Land Registry and all of the Title Number(s) and/or Interest Number(s) that are affected by the name change.

PARAGRAPH 2 – SAME PERSON
The individual swearing the affidavit must swear that he/she is the same person as noted in both Sections A and B of the application form.  This is because it is possible for two completely separate individuals to have the same name, by making an oath saying the above you are indicating that you have done your due diligence to ensure the titles or interests for that client number are owned by you.

PARAGRAPH 3 – PURPOSE
A name change affidavit must have a statement as to purpose.

PARAGRAPH 4 – REASONS FOR NAME CHANGE
Indicate the reason for the Individual Change of Name application must be indicated and include a copy of the requested documentation.

Please only indicate one reason for the change of name. 

SIGNATURE AND JURAT
The applicant must sign on the Client Signature line.

In the Jurat section, completed by the oath taker, indicate the Place, Province and the Date (day, month year), which indicates where and when the Affidavit was sworn or affirmed.

Have a Commissioner for Oaths for Saskatchewan or Notary Public or Solicitor sign on the line.

Enter commission /appointment expiry date of the Commissioner/Notary Public.  If there is not expiry date of the oath is taken by a Commissioner/Notary Public who holds the position by way of profession, please indicate the profession (i.e. police officer, solicitor, etc.).

If the Affidavit is sworn or affirmed outside Saskatchewan by an official under their official seal, ensure that the seal is clearly visible when submitted to ISC. For information on who may commission an Affidavit outside of Saskatchewan, please see section 24 of The Land Titles Regulations, 2001, available from Queen’s Printer, B19-3085 Albert St., Regina, SK S4S 0B1 or www.qp.gov.sk.ca.

Note: If the witness wishes to affirm, please make the appropriate changes to the Affidavit.
