All uncertified mineral titles in producing areas have been locked with this lock to provide notice that mineral certification has not taken place.
On December 6, 2004 section 69 of The Land Titles Regulations, 2001 was amended to add a section 69.2 This new section will now permit transfers of uncertified mineral titles in a producing area.
69.2 Pursuant to subsection 48(2) of the Act, a transfer respecting an uncertified mineral title may be registered in the land titles registry if the title that is the subject of a transfer is within a township listed in Appendix 3.
An uncertified mineral title is not considered a title within the definition contained in Section 3(rr) of The Land Titles Act, 2002. Uncertified mineral titles within a producing area may be transferred at the parties' own risk. Certification of the mineral ownership must be completed prior to an uncertified mineral title becoming a title as defined in The Land Titles Act, 2000.
This lock is registered at the title level and will appear on a title print.
Functionality of the Lock
This is a Notice Lock Type and will not prevent any transactions.
Removal of the Lock
The lock may only be removed on certification of the mineral ownership.
