Joint Tenants with No Survivorship

A Joint Tenants with No Survivorship lock is used to indicate the title is held by a trustee pursuant to Section 34(3.1) of The Land Titles Act, 2000

This lock was also applied at the time of conversion when a certificate of title contained a reference to trustees. The reference to trustees was removed and this lock was applied. For example, a reference to John Smith and Mary Smith as trustees for the ABC Church was converted to John Smith and Mary Smith with the Joint Tenants with No Survivorship lock placed on the title.

This lock is registered at the title level and it will appear on a title print at the bottom.

Functionality of the Lock

This lock will prohibit:

  • application by a surviving joint tenant

This lock will not prohibit:

  • title transfer
  • alternate authority set-up
  • interest registration
  • interest postponement
  • interest amendment
  • interest assignment
  • interest discharge
  • interest registration of a judgment

Removal of the Lock

This lock will not be removed so long as the title continues to be held by joint tenants with no right of survivorship. A court order will be required to deal with the title.
