Fee Mitigation – Estates

Under The Land Titles Act, 2000, a title held by a deceased person must be transmitted into the name of a personal representative before it can be transferred.  Some land registry transactions will require a title that is held by the personal representative to be transferred back into the name of the deceased to allow the transaction to register.  Once the transaction is registered, the new title can be transmitted into the name of the personal representative.  The appointment of a new personal representative or a transform involving a title held by the personal representative are examples of these types of transactions. Fee mitigation may apply in these instances.
