Tips for Researching Parking Space Designations

Plans Approved Prior to 1995
  • Prior to 1995, Condo Plans were not required to show parking spaces
  • Inquiries should be made into encumbrance sheets which would have listed parking space allocations, whether any bylaws or agreements exist governing parking spaces, and whether there have been any plan amendments whereby the 1995-2014 requirements, or the post June 2014 requirements apply
  • Note many of the pre 1995 plans did show parking space allocations, and not all plans had encumbrance sheets attached

Plans Approved Between 1995 and June 2014

  • Parking spaces and parking designations are shown on the plan
  • If there was a redesignation of a parking space, it would be shown as an interest on the title receiving the space and if there was a further redesignation, an assignment would be noted on the title containing the redesignation interest
  • Condo plans would also be amended showing the redesignation
  • Inquiries should be made into the space allocation on the actual plan and into any amendments thereof, and whether the title notes any redesignations or whether any the post June 2014 requirements apply

Plans Approved After June 2014

  • Parking interests are designated at the time titles are raised
  • Parking space designations are not required to be shown on the plan
  • Previous parking redesignation interests may have become parking designation interests
  • If transferring ownership of a unit based on a plan approved after June 16th, 2014 inquiries should be made into parking designation interests listed on the unit title and audits of the interest registrar number
