Easement Analysis

As part of the plan examination process, applicants may ask to have ISC conduct research and identify which easement interests apply to which parcels, eliminating the need to prepare a number of interest discharge documents to the Land Registry.

A rate of $125 per hour applies. Typical timeframes, based on the number of easements examined, are:
  • 0 - 5 easements: 2 hours 
  • 6 -10 easements: 3 hours
  • 11 - 20 easements: 4 hours
  • 20 or more easements: over 4 hours

How Do I Request this Service?

You can request this service in one of two ways:
  1. When submitting a new plan, include your request in the letter of submission you send to Plan Processing; or
  2. After the Transform Approval Certificate (TAC) has been issued, email your request to [email protected]

What Do I Require?

All requests will require a Client and Account number (with passwords) for processing. A current email address is also required. NOTE: This service is similar to the work previously performed by title workers in the paper-based system, who examined interests on land to be subdivided and determined whether they would affect a specific area within the subdivision. An easement interest would then be attached to the area affected, rather than against the entire subdivided area. With the online land titles system, all interests on land that are going to be subdivided are automatically applied to all new parcels in the subdivision. Affected parties are then required to prepare a number of interest discharge documents for submission to the Land Titles Registry to remove the easements from those titles that should not have been affected. While clients still have the option of completing this work on their own, this service eliminates the need to complete the interest discharge documents and enables the titles to be dealt with more quickly.

What Happens After Submitting My Request?

Once your request has been processed, you will receive a Notification of Easement Analysis document. This must be included in the land titles packet submission behind the authorization of title surrender. As this document is not automatically produced, you will usually receive the Notification of Easement Analysis after you have received the Transform Approval Certificate.
