Redivision of Units

An owner of a condominium unit may redivide his or her unit, pursuant to section 25 of The Condominium Property Act, 1993 (“the Act”). An example of a redivision is dividing one large unit into two smaller ones, or creating one larger unit from two existing units.

A redivision requires approval from the local authority and the condominium corporation where new services units or common property are created. Redivision can be accomplished by either amending the current condominium plan or, where it is deemed necessary, by a new condominium plan. When a redivision occurs, the title(s) to the unit(s) being redivided must be surrendered, and title(s) to the new unit(s) must be set up. The unit factors for the original unit(s) must be apportioned among the units created in the redivision.

In general, the process requires two main steps: 

  1. the approval by Plan Processing of a plan amendment or a new plan; and
  2. issuance of titles by the Registrar of Titles.

A separate application must be made for each of these steps. This guide will help you in applying for titles when the redivision of a condominium unit or units has been approved. Alternatively, these applications may now be done by utilizing our Online Submission Tool (OLS). However, first, we will discuss briefly the process by which a new plan or a plan amendment is approved.

APPROVAL OF PLAN OR PLAN AMENDMENT

REDIVISION BY A NEW PLAN
In certain circumstances, the Controller of Surveys will require a new condominium plan. This may occur when a significant change is involved in the particular redivision. In this case, the new plan replaces the current condominium plan. When a new plan is approved, a Transform Approval Certificate (TAC) is issued. The client may then apply to the Land Registry to surrender the existing titles to the units and to set up titles to the units as they are shown on the new plan. All the units must be issued new titles to reflect the new plan number.

REDIVISION BY PLAN AMENDMENT
If the Controller of Surveys permits the redivision to occur by amending the current plan, the client will hire a surveyor to prepare a plan showing the new unit boundaries being created. This amendment plan is then submitted for approval. The client may be required to submit other documents such as:

  • Local Authority Approval
  • Application for Plan Amendment Change Order
  • Condominium Redivision Schedule
  • Approval of the condominium corporation in the prescribed form(Form NN)

The Condominium Redivision Schedule indicates which units are being redivided into which new units. It is examined and confirmed by Plan Processing and a copy returned to the client. The endorsed Condominium Redivision Schedule will later be used in the application for issuance of titles.

Once the amendment is approved, Plan Processing notifies the client by providing a Certificate of Approval (in the form of a letter). An interest analysis/schedule of interests affecting all owners is performed and material is sent to the client to be added into the packet. The client then applies to the Land Registry for titles to be issued to the new unit or units that were created by the redivision.

Since most redivisions are likely to occur by plan amendment, the following instructions will apply to that process.
