Interests

An interest on a source parcel will automatically carry forward to any new parcel(s) created from that source parcel.   For example, if parcel A is subdivided into parcels B and C, a mortgage against A will carry forward to B and C. This is a “semi-intelligent” carry forward in that the system will carry an interest to all parcels that result from a source parcel, but will not carry the interest to any unrelated new parcels.   

Sometimes, you may not want the new parcel to be subject to a carry forward interest.  In that case, you have two options:

  1. Discharge the interest  -  You must wait until the new title has issued before submitting a packet to discharge interests. An interest discharge application requires the Interest Number, which is not available until after the new titles are issued.  Discharges of interests are free.
  2. Request an analysis – In some cases, you can request an easement analysis be completed by ISC.
 
You should request this service before you prepare the packet.  After ISC finishes its analysis, you will be provided with a document entitled “Notification of Easement Analysis” to insert after the Application for Transfer (Part I: Surrender).  Our processing staff rely on the document to determine when these interests should carry forward to new parcels and when they should not.
