Designation of Parking Space

Several changes to The Condominium Property Act, 1993 went into effect on June 16, 2014. One of the changes is the process of how parking spaces on a condominium plan are designated to units. The customer must now designate parking at the time of raising titles to a condominium plan as opposed to designating parking on the condominium plan itself. This is done by registering a Condominium Property Act – Parking Designation interest on title. A revised Form F.1 must be included in the application as an attachment.
 
If parking spaces are included as part of the condominium plan, a unique parking designation interest must be registered against each designated unit title for each parking space. If multiple parking spaces are to be designated to a single unit then a unique parking designation interest for each parking space must be registered against the unit title. The parking designation interests must be registered in the same packet as the initial setup of the condominium unit titles raised from the plan.
 
The new parking designation interest can also be amended. This is how a parking space is re-designated. Each unit must maintain a minimum designation of at least one parking space. If a parking space is to be re-designated from a pre June 16th, 2014 condominium plan, it will have to be registered first on the title that currently has the designation on the plan, and then that interest will have to be amended add it to the new residential unit receiving the benefit of the parking space.
