Designation of Parking Space – Forms Steps

Parking is a key issue for condominiums. Each new condominium plan must indicate that the developer has designated an appropriate area for at least one parking space for each residential unit.

Parking can be allocated by unit, in which case a separate title is linked to the residential unit title. Parking can also be allocated by space, in which case the allocation will appear as a “parking designation” on the title if the condominium plan was approved and titles were issued after June 16th, 2014. If the plan was approved and titles were issued between 1995 and June 16th, 2014, a parking space designation will appear on the plan. All parking space designations on condominium plans approved before June 16th, 2014 remain valid and new registrations on residential units are not required.

All residential units must allocate parking spaces or units at the time titles are initially set up. If parking spaces are to be used, this must be done by interest registrations in the same packet as initial set ups. Applications must include Form F.1 as prescribed by the Act.

Parking designation can be completed through forms by following the outlined steps.

If you are redesignating a parking space that is currently registered on a condominium plan, a “Parking Designation” interest will first have to be registered on the residential unit title that currently holds the parking space designation. Step 1: COMPLETING FORM F.1

If the developer wants to designate parking spaces at the time titles are issued, the designations must be in written form and registered on titles. This can be done by completing the Designation of Parking form (Form F.1), which can be found in the regulations pursuant to the Act. The Queen's Printer provides access to all forms under the Act.   • Add in the Residential Unit Number in accordance with the approved plan.
  • Designate the parking space or unit if the condominium development utilizes both types of parking.
  • Allocate parking spaces to each unit (i.e. p 1, p 2)

NOTE: Please include all units and parking space in the prescribed form (F.1).

Step 2: REGISTERING THE INTERESTS ON TITLES

The parking interest designation must be registered against the titles in the same packet as the initial setup of the condominium unit titles raised from the plan.

B. Complete Forms and Assemble Packet

Complete the forms and assemble packet in the following order:

1. Condominium Packet Cover Page
Complete the other forms first, and then return to complete the Condominium Packet Cover Page as follows:

Packet Sheet Count – Enter the total of all the pages in the packet, including the Cover Page.

Application Count – Enter “1” if the Interest Application is the sole application in the packet.

Section A – If as the submitting party, you already have a client number, complete this section only. Insert your client number, your internal client reference number (optional), account number and account password. (If you do not have a client number, please complete Sections B and C).

2. Application for Interest Registration
Complete the form as follows:

Application Sequence Number
– Insert “1”.

Application Sheet Count – “N/A”

Interest Type – Enter the type: “Condominium Property Act – Parking Designation”

No conditions – Check off this box.

Attach Interest to - Enter the title number for the unit or units involved in the designation. Note there will be only one title per designation as they may only be submitted one at a time.

Fractional Title Share – Enter “1/1” as there is only one holder. A holder is the party benefitting from the designation of the parking space.

Section A – Interest Holder – Insert the correct client number and name of the holder. The holder may be the owner(s) of the unit gaining the space, or where the space is to be a non-exclusive area, the holder will be the condominium corporation or where this is an initial set up, it may be the developer. Note it must be completed for each interest holder.

3. Begin Attachment Sheet
Insert Form F.1 after this sheet.

Step 3: SUBMITTING THE PACKET

 When you have completed and assembled the above forms, you are ready to submit the packet to the Land Registry.

Submission of original documents is discouraged, as any rejected packets are not returned to you. If faxing the packet, please check to ensure that the forms will be legible when faxed to us. The system will accept only 8 1/2" by 11" letter-sized paper, no matter which method of submission is used.

CONVERSION NOTE

In the old paper-based land titles system, parking space designations were recorded on the encumbrance sheet which accompanied the condominium plan. As each district was converted to the new system, the encumbrance sheet was imaged and attached to the Certificate of Title for each unit.

If you are looking for any parking designations that pre-date when a district is converted, these may not available by reviewing the condominium plan or current titles. Note that prior to June 16th, 2014 changes in parking space allocations required a plan amendment. This will no longer be necessary unless a parking space allocated to a residential unit is to become common property.
