Redesignation of Parking Spaces – Forms Steps

To redesignate a condominium parking space, an interest amendment application must be submitted to ISC. Applications must include an attached Form D as prescribed by the Act and it is submitted as an attachment. An interest authorization will also be required.

Note “Form D – Parking Space Redesignation Form” is used to register or amend a “Condominium Property Act – Designation of Parking” interest on title and this interest type should be selected when applying to register.

If it is an amendment to an existing parking designation interest, the residential unit receiving the benefit of parking interest will have the interest appear on its title. The title of the residential unit giving up the parking space will have a notice of expiry appear under the interest. After 30 days, the interest will disappear from the title that has given up the parking space.

Parking redesignation can be completed through forms by following the outlined steps. Redesignations may be done through interest amendment where a parking designation interest is currently registered on title. If the parking designation is current noted on the condominium plan, a “parking designation” interest must first be registered against the title which currently has the space designated on the plan. The interest can then be amended to attach it to the residential title receiving the benefit of the parking space.

If there is no parking designation interest registered on title, an interest registration must be completed.

If a parking redesignation interest appears on title, a parking interest designation must be registered on the current title and then amended to be added to the title acquiring the parking designation. ISC staff will remove the redesignation interest from the original when the application to register the parking designation is made.

Step 1: COMPLETING FORM D

The owner of a unit can redesignate a parking space if he or she wishes to do so. This is done by completing the Parking Space Redesignation form (Form D), which can be found in the regulations pursuant to the Act. The Queen's Printer provides access to all forms under the Act. These forms can be found here.

  • The owner completes and signs the first part.
  • If the unit is subject to any mortgage(s), the mortgagee who is first entitled in priority must also approve the designation. The mortgagee completes the middle portion of Form D. Notice is given to the condominium corporation. 

 

Step 2: REGISTERING THE INTEREST(S) ON TITLE(S)

If the parking space is going from one unit to another unit, interest amendments must be registered against the titles to both units.

B. Complete Forms and Assemble Packet

Complete the forms and assemble packet in the following order:

1. Condominium Packet Cover Page
Complete the other forms first, and then return to complete the Condominium Packet Cover Page as follows:

Packet Sheet Count – Enter the total of all the pages in the packet, including the Cover Page.

Application Count – Enter “1” if the Interest Application is the sole application in the packet.

Section A – If as the submitting party, you already have a client number, complete this section only. Insert your client number, your internal client reference number (optional), account number and account password. (If you do not have a client number, please complete Sections B and C).

2. Application for Interest Registration or Interest Amendment 
Complete as follows:

Application Sequence Number – Insert “1”.

Application Sheet Count – “N/A”

Interest Type – Enter the type: “Condominium Property Act – Parking Designation”

No conditions – Check off this box.

Description of Interest – Enter the space number (p1, p2, etc.).

Attach Interest to
- Enter the title number for the residential unit or units involved in the designation. Note there will be only one title per designation as they may only be submitted one at a time.

Fractional Title Share – Enter “1/1” as there is only one holder. A holder is the party benefitting from the designation of the parking space.

please complete pg. 2 with the appropriate information.

Section A – Interest Holder
– Insert the correct client number and name of the holder. The holder may be the owner(s) of the unit gaining the space.

2. Begin Attachment Sheet
Insert Form D after this sheet.

NOTE: Registration of this type of interest requires both a description and an attachment. If done through an amendment, an authorization is also required.

Step 3: SUBMITTING THE PACKET

When you have completed and assembled the above forms, you are ready to submit the packet to the Land Registry.

Submission of original documents is discouraged, as any rejected packets are not returned to you. If faxing the packet, please check to ensure that the forms will be legible when faxed to us. The system will accept only 8 1/2" by 11" letter-sized paper, no matter which method of submission is used. Packets may be submitted to:

CONVERSION NOTE

In the old paper-based land titles system, parking space designations were recorded on the encumbrance sheet which accompanied the condominium plan. As each district was converted to the new system, the encumbrance sheet was imaged and attached to the Certificate of Title for each unit.

If you are looking for any parking designations that pre-date when a district is converted, these may not available by reviewing the condominium plan or current titles. You must locate and review the former encumbrance sheet. If you require further assistance, please contact our Customer Support Team.

Note that prior to June 16th, 2014 changes in parking space allocations required a plan amendment. This will no longer be necessary unless a parking space allocated to a residential unit is to become common property.
